SERVICE PROVIDED BY THE COMPANY TOKYWOKY

The company referred to as TOKYWOKY (hereinafter referred to as "TOKYWOKY") provides its clients ("The Clients") with a service ("The Service") allowing visitors of the website ("The Users") to react to the content published by the community as posts ("The Posts").The purpose of TOKYWOKY is to allow the Users to discuss and help each other in real time.

Using TokyWoky allows you to share information, experiences and discussions by sending private messages. No messages of a promotional nature are authorised. For the good use of this service and for its quality, we ask you to be attentive to messages, personal data or comments that you write and communicate in private messages. Are intentionally prohibited and liable to incur the responsibility of the User, all insulting, denigrating statements that contravene laws and regulations, including interfering with the integrity of the person, copyright, trademark law, intellectual property, image right andrespect of private life.

TOKYWOKY may at any time and without notice modify the Service provided to Users, stop its functioning and limit its scope.

TOKYWOKY strives to provide a service 24 hours a day, 7 days a week .Users acknowledge that TOKYWOKY is not responsible for:

Service disruptions related to breakdowns and required maintenance operations
Inaccessibility of the Service due to force majeure or an out of control event

 

OBJECT OF THE GENERAL CONDITIONS OF USE

These general conditions ("General Conditions") frame the conditions of use of the service provided by TOKYWOKY to Users on the platform located at the following web addresshttp://www.tokywoky.com/ as well as:

In cases where Users don't respect the General Conditions TOKYWOKY may at any time terminate Users access and remove data provided by Users upon registration ("RegistrationData") and the use of the Service provided by TOKYWOKY ("Usage Data").TOKYWOKY will have no obligation to keep the Registration or Usage Data or to transmit it to a third party.

  • The use of Registration Data provided by Users to TOKYWOKY when they open an account (the "Account") on this address
  • Use of Usage Data provided by Users

PURPOSE AND UTILIZATION OF YOUR PERSONAL DATA

 

Login-Authentication-Account management

The first purpose of TokyWoky's data collection is to facilitate the User's browsing and enable him to keep a history of his interactions. His email and password permit him to create a TokyWoky account which will be associated with his points, his profile picture and his questions and answers.

 

Moderation

The content created by the User (questions and answers) is kept by TokyWoky. It is visible to its client sites for purpose of moderation in order to guarantee the quality of service rendered to the Users.

Discussions between TokyWoky Users (besides questions and answers) are private except for discussions between a User and an administrator. These can be read by the administrators.

The personal data collected from Users is usedto give access to the Platform's services, improve them, enliven the Platform and maintain a secure environment.

More specifically, these uses are the following:

  • Access to and use of the Platform by the User;
  • Manage the Platform's use and optimization;
  • Verification, identification, and authentication of data transmitted by the User;
  • Offer Users the possibility to communicate withcoaches;
  • Management of possible disputes;
  • Prevention and detection of fraud, malware (malicious software ) and management of security incidents;

 

DATA COLLECTED ON OUR SITE

 

What data?

We collect and manage your email address, profile photo, password, IP address, connection information and the content that you created on TokyWoky.(Questions, answers, discussions).

For "coaches" we also collected data on location, age, and a biography furnished by the User in the coaching space.This data can be seen by TokyWoky, the other coaches, and client sites of TokyWoky.

We also measure audience, for example, we measure the number of pages seen, the number of site visits, as well as activity of visitors to the site and how often they return.

 

When

We collect the information that you provide, especially when:

  • You register with TokyWoky
  • You fill out/update your coach profile
  • You post a question or respond to a question

 

DATA RECIPIENTS

The data collected on the TOKYWOKY site belongs to the host site ofTokyWoky.The TOKYWOKY host site is responsible for managing this data and the management of personal data is done in accordance with the applicable legislation ("Data Protection Act" law nº78-17of 6 January 1978 and general regulations covering data protection).It can only be used by the latter within the framework of the present User Agreement, meaning:

Connection, account use and management;
Moderation of User publications;

Personal data can be shared with third parties in the following cases:

  • When the User posts information accessible to others Users;
  • When a User has a discussion with another User;
  • When TOKYWOKY engages third-party contractors for certain services. These contractors have limited access to User data within the framework of executing the contracted services, and have the contractual obligation to use it in accordance with the applicable regulations regarding the protection of personal data;
  • If required by law, TOKYWOKY may transmit data in response to claims against TOKYWOKY and to comply with administrative and judicial procedures;
  • If TOKYWOKY is involved in a merger operation, acquisition and/or transfer of assets or bankruptcy proceedings, it may be required to transfer or share all or part of its assets, including personal data. In this case, the Users would be informed.

 

YOUR RIGHTS UNDER THE DATA PROTECTION ACT

You are informed that when creating "Coach" accounts, the party responsible for processing personal data is the company TOKYWOKY SAS with which your rights of access, rectification and deletion of data are exercised in accordance with the applicable regulations.

In accordance with the regulations applicable to personal data, Users have the following rights:

  • They can update or delete their data by logging into their account and configuring the settings of this account;
  • They can delete their account by writing to the following email address: team@tokywoky.com. It should be noted that information shared with other users – while anonymized - can remain visible to the public on the platform, even after the account is deleted;
  • They can exercise their right to access, in order to consult their personal data, by writing to the following email addressteam@tokywoky.com.In this case, before granting access to this right, TOKYWOKY can ask for proof of identity from the User in order to check the accuracy;
  • If the personal data retained by TOKYWOKY is incorrect, they can request that the information be updated by writing to the following email address: team@tokywoky.com ;
  • Users can request the deletion of their personal data in compliance with personal data protection laws, by writing to the following email address:team@tokywoky.com.

The TOKYWOKY cookies

TOKYWOKY is designed to facilitate peer support among clients of a third-party site.It is for this use, among others, that we use cookies in order to identify you, exchange with other visitors and preserve your interactions on the TokyWoky modules from one session to another. The cookie is a record of information saved by TOKYWOKY on your computer: its aim is to simplify your navigation. It cannot contain viruses.

TOKYWOKY cookies last 12 months. After this period, they will be automatically deleted. If you are not registered on TOKYWOKY you will, in this way, lose all the usage data about you.

When you access the tokywoky.com site, the cookies of partner companies ("third-party cookies") can be stored on your computer. These cookies are only ever from Google Analytics and/or New Relic. These third-party cookies are used to monitor use of TokyWoky in order to optimize its user interface and improve your navigation experience.

We assure you that TOKYWOKY does not have access and cannot exercise any control over third-party cookies. Nonetheless, we ensure that partner companies agree to manage the data collected on the TokyWoky.com site exclusively for the needs of TOKYWOKY, in accordance with the law " Data Protection Act" of 6 January 1978 modified and commit to implementing the appropriate means of securing and protecting data confidentiality

We inform users that they can refuse third-party cookies.

 

EVOLUTION OF THE PRESENT CLAUSE

TOKYWOKY reserves the right to make any changes to the General Conditions at any time. If a modification is made to the present, TOKYWOKY will publish a new version on its site. TOKYWOKY will also inform users of the modification by electronic message within a minimum period of 15 days before the date it becomes effective. If a user does not agree with the terms of the new version of the General Conditions and in particular the clauses related to personal data protection, that user can delete his account.
